Access to and use of the Form King API is conditional upon your acceptance of these API Terms of Use ("API Terms"). These terms supplement the general Form King Terms of Service. By accepting these API Terms, or by accessing or using the Form King API, you agree to be bound by them.
The API is available exclusively to active Form King Web subscribers for personal, non-commercial use. You expressly warrant that you will not use the API, API Data, or Derived Data:
The API is provided solely for your own private, personal, non-commercial use, including your own personal wagering activities and your own personal analysis. You may use the API and API Data to build, train, and back-test personal machine-learning or statistical betting models (Personal Models) for your own private, non-commercial use.
You must not use the API, API Data, or Derived Data, directly or indirectly, to:
A Personal Model may be Commercialised without Form King's prior written approval, provided that doing so does not involve any of the activities prohibited above. The "Powered by Form King" attribution required below for your own tips and rated prices is expressly pre-approved by these API Terms and does not itself require any further approval. You only need Form King's prior written approval (which may be subject to a commercial licence fee or revenue share) if you wish to: (a) use "Form King" as a product or service brand, or otherwise describe a product or service as being affiliated with, powered by, or sourced from Form King in a way that implies an official Form King feed or partnership, as distinct from the personal tip-sheet attribution described below; or (b) ship a data product that is built on, or substantially reproduces, API Data or Derived Data. If you wish to explore either of these, contact admin@formking.com.au before taking any commercial steps (including fundraising, incorporation for that purpose, marketing, or sale).
Your Own Rated Prices and Tips Are Not API Data or Derived Data. A rated price, tip, or selection that is your own number or view — that is, one that is not a direct restatement, quotation, or paraphrase of Form King's Neural, EXP, or other proprietary ratings or benchmarks — is not, of itself, API Data or Derived Data, and sharing it is not a breach of Section 6 (No Third-Party Sharing).
Provision of Tips and Ratings to Third Parties. Notwithstanding the above, and without derogating from Section 6 (No Third-Party Sharing), you may provide your own betting selections ("tips"), and your own or your model's rated price, to third-party subscribers or clients (for example, as a racing tipster), provided that:
This provision does not permit the sale, sub-licensing, or Commercialisation of the API, API Data, or Derived Data itself. For clarity, where your tipping or advisory service provides only your own tips and rated prices (and no API Data or Derived Data), that service is a Personal Model and may be Commercialised in accordance with this Section 3 without any further approval; the preceding sentence does not impose any additional approval requirement on it.
You must keep your API key private and confidential. You must not share your API key with any third party or make it available to any other party, including to pool or aggregate credits or rate-limit allowances across users. You are responsible for all calls made to the API using your credentials.
Data retrieved via the API is provided by Mediality Racing on behalf of Racing Australia and the Australian state Principal Racing Authorities.
You must not share, disclose, sub-license, sell, transfer, publish, display, mirror, or otherwise make available any API Data or Derived Data to any third party, for any purpose, at any time, unless Form King and, where applicable, Mediality Racing/Racing Australia, have given prior written consent. This applies regardless of whether the sharing is free of charge, commercial, internal to another organisation, or between related entities. For clarity, sharing your own rated prices or tips in accordance with Section 3 is not a breach of this Section 6.
You may cache API Data locally for your own use for so long as your subscription and API access remain active, solely for the purpose of optimising your credit usage and the performance of your own personal use of the API, provided that such cache is never distributed, transferred, shared, or otherwise made available to any third party in any way.
Upon the cessation, cancellation, expiry, or termination of your Form King subscription or API access for any reason, your right to use the API and the API Data ends immediately. A pause in your subscription or API access of up to three (3) months is treated as continuous access for the purposes of this Section 7 and does not, of itself, trigger the destruction obligations below; those obligations apply once your subscription or API access has ceased for more than three (3) months, or you have cancelled or been terminated outright. Except where Form King has granted a prior written exception, you must, within 30 days of that point:
Backup Carve-Out. Where API Data or Derived Data continues to exist solely within an automated backup system after you have complied with the above, you are not in breach of these API Terms provided that: (a) you do not restore, access, or make active use of that backup copy; and (b) it is overwritten or purged in the ordinary course of your backup system's normal retention cycle, without any deliberate act on your part to retain it for longer than that cycle.
Retention of Personal Models. You may retain and continue to use a Personal Model after your subscription or API access ends, provided that: (a) it meets the definition of Personal Model in Section 1 (that is, it does not contain, embed, or allow the reconstruction of API Data or a substitute for it); (b) you do not use it, directly or indirectly, to rebuild, refresh, repopulate, or otherwise reconstitute a Form King-equivalent database or dataset without a live subscription and API access; and (c) any Commercialisation of that Personal Model remains subject to Section 3.
These obligations, and the restriction on future Commercialisation in Section 3, survive termination of these API Terms.
Historical and Vintage Data Bundle Purchases. If you separately purchase a historical or "vintage" data bundle, that purchase requires an active Form King subscription at the time of purchase. The destruction obligations in this Section 7 do not apply to that historical bundle. Instead, the licence to use that specific historical bundle survives the later cancellation of your live subscription, but remains personal to you and subject to these API Terms in all other respects (including Sections 3, 6, and 9): it is not refreshed, updated, or supplemented with new data once your live subscription ends, and it must not be republished, redistributed, or otherwise shared with any third party.
Form King may monitor API usage patterns for the purpose of detecting abuse, bulk scraping, and other breaches of these API Terms. Where Form King reasonably suspects a material breach of these API Terms, Form King may give you written notice requiring you to confirm, within a reasonable time specified in that notice, the extent of any API Data or Derived Data in your possession, custody, or control that relates to the suspected breach, and to provide reasonable confirmation that any such data required to be destroyed under Section 7 has in fact been destroyed. This Section does not entitle Form King to an open-ended or ongoing right to inspect your devices or systems in the absence of a suspected material breach.
All API Data, and all intellectual property rights therein, are and remain, at all times, the exclusive property of Form King and, where applicable, Mediality Racing, Racing Australia, and the relevant Principal Racing Authorities (together, the "Data Owners"). Nothing in these API Terms transfers, assigns, or grants any ownership interest in the API or API Data to you, regardless of the extent to which you have accessed, retrieved, stored, cached, processed, or paid for such data.
Your subscription fee and any credit purchases are consideration solely for a limited, revocable, non-exclusive, non-transferable licence to access and use the API and API Data for so long as your subscription and/or credits remain active and in accordance with these API Terms. They do not constitute payment for, or transfer of, the data itself, and confer no right to retain, use, or benefit from API Data or Derived Data once your subscription or API access ceases, except as otherwise expressly permitted in Section 7 (Termination and Data Destruction).
As between you and Form King, Form King and/or Mediality Racing retain all right, title, and interest in and to the API and API Data. You are granted only a limited, revocable, non-exclusive, non-transferable licence to access and use the API and API Data strictly in accordance with these API Terms, for so long as that access remains live. No other rights are granted, whether by implication, estoppel, or otherwise.
Your Code and Personal Models. For the avoidance of doubt, nothing in this Section 9 affects your ownership of your own source code, or of a Personal Model that you have developed, subject at all times to the use, retention, and Commercialisation restrictions in Sections 3 and 7. Form King does not claim any ownership interest in your Personal Models or your code.
To the maximum extent permitted by law, Form King accepts no liability, and you release and discharge Form King, for any loss, damage, cost, or expense (whether direct, indirect, consequential, or otherwise) arising out of or in connection with any activity you, or any third party, undertake in reliance on, or in connection with, the API, API Data, or Derived Data, including but not limited to: wagering, betting, or other gambling activity; tips, selections, or recommendations you give or receive; and any advice, instructions, ratings, or rated prices you provide to, or receive from, any third party. You acknowledge that all such activities are undertaken entirely at your own (or that third party's) risk.
You agree to indemnify and hold Form King harmless from and against any losses, damages, costs, or expenses (including legal costs) arising from or in connection with: (a) your breach of these API Terms, including any unauthorised sharing, distribution, retention, or Commercialisation of API Data or Derived Data, or any unauthorised or excessive access to the API; and (b) any wagering activity, tipping or recommendations, or advice or instructions given by you to any third party, whether or not made in connection with, or informed by, the API, API Data, or Derived Data.
Nothing in these API Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the Australian Consumer Law or any other applicable law and cannot lawfully be excluded, restricted, or modified.
Form King may suspend or terminate your access to the API immediately and without notice if it reasonably suspects a breach of these API Terms, including suspected bulk scraping, credential sharing, unauthorised third-party sharing, or unauthorised Commercialisation.
You acknowledge and agree that Form King is required, under its contractual arrangements with Mediality Racing and its constituent bodies (including Racing Australia and the relevant Principal Racing Authorities), to report to Mediality Racing (and, where applicable, those constituents) any suspected material misuse of API Data, such as bulk scraping, unauthorised supply to a Wagering Service Provider, or unauthorised redistribution, whether or not Form King has taken or completed its own investigation into the suspected misuse.
Form King may update these API Terms from time to time. Where changes are material, Form King will provide reasonable notice. Your continued use of the API after such changes take effect constitutes your acceptance of the updated API Terms.
These API Terms are governed by the laws of Tasmania, Australia, and you submit to the non-exclusive jurisdiction of the courts of Tasmania.
